3.3     Users using the services of FIN-GPT are advised to recognize and accept the inherent risks associated with market fluctuations. While we strive to provide financial assistance, we do not assure a complete return guarantee, acknowledging the influence of external market factors on investment outcomes.

3.4 The fees associated with premium user accounts are communicated based on client-specific considerations.

3.5 FIN-GPT, as a financial assistance platform, acknowledges that clients’ portfolios are susceptible to market volatility. We explicitly state that we do not guarantee a 100% return assurance policy, as market conditions are subject to externalities beyond our control.

• Eligibility

5.1 By using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract.

5.2 The Services are not targeted towards, nor intended for use by, anyone under the age of 18. If you are under the age of 18, you may not use the Services.

• Account Registration

6.1 In order to access certain features of the Services, you must register for an account (“Account”). When registering for an Account, you agree to provide accurate, current, and complete information about yourself as prompted by the registration form.

6.2 You are responsible for maintaining the confidentiality of your Account login information and are fully responsible for all activities that occur under your Account.

• Fees and Payment

7.1 FIN-GPT provides users with flexibility in usage models: opt for the Pay-per-Query Model, incurring charges for each query submitted, or experience uninterrupted access throughout the subscription period under our Subscription Model.

7.2 Users are required to fulfil the payment obligations upon the prompt receipt of the invoice.

7.3 Non-compliance with the stipulated payment timelines may result in the suspension or termination of access to FIN-GPT.

8.1 All intellectual property rights within FIN-GPT, including copyrights, trademarks, and trade secrets, are owned by FIN-GPT or its licensors.

8.2 Users are granted a limited, non-exclusive license for internal business purposes, subject to compliance with these Terms.

12.1 Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, or the breach, termination, or validity thereof, shall be resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator, mutually appointed by the parties.

12.2 The seat of arbitration shall be Kochi, Kerala, and the language of the arbitration shall be English. The arbitration proceedings and the award rendered shall be confidential and may not be disclosed to any third party, except as required by law.

12.3 This dispute resolution clause shall survive the termination or expiration of these Terms and Conditions.
